Experience
- Acted for a constitutional commission in constitutional and appellate proceedings concerning the interpretation and validity of amendments to the Political Parties Act and their interaction with the Constitution and the Elections Act, raising significant questions on political party nominations, coalition political parties, indirect nominations, political rights, public participation and the respective constitutional mandates of electoral institutions.
- Represented a commercial bank in an appeal before the Court of Appeal arising from a dispute over an allegedly unauthorised banking transaction, involving questions of contractual liability, allegations of fraud and illegality, limitation, and the circumstances in which a financial institution could properly be held liable for a disputed transaction. The appeal was allowed in favour of the bank, the trial court's judgment was set aside, and the claim against the bank was dismissed.
- Represented a county government in employment and labour proceedings arising from a challenge to the termination of its employees, involving questions on the lawfulness of the termination, the obligations of a public employer, and the remedies available in employment disputes. Has also advised public sector institutions on employment, contractual and administrative law issues.
- Represented clients in disputes over competing claims to land and proprietary interests, including questions of ownership, occupation and contractual rights over property, before the Environment and Land Court and the subordinate courts, and through negotiated and court annexed dispute resolution where appropriate.
- Represented clients in contentious succession and family disputes involving competing interests in estates, administration and distribution of property, parental responsibility and related family rights, combining court proceedings with negotiated and alternative dispute resolution where appropriate.
